Official Rules and Restrictions

Introduction

The Official Rules and Restrictions (the "Official Rules") apply to all participants of the ResortQuest Vacation Treasure Hunt (also called the "Contest"), which will run weekly during the period of January 19, 2010 through September 28, 2010 ("Promotion Period"). By participating in this contest of skill, you acknowledge that you have read these Official Rules as well as the Terms and Conditions, and that you agree to abide by, and be subject to, the Official Rules and the Terms and Conditions, as well as the decisions of the judges, which shall be final and binding in all respects. In these Official Rules, "you," "your" and "participants" refers to you, the person who has participated in ResortQuest's Vacation Treasure Hunt.

1. CONTEST OF SKILL: RESORTQUEST'S VACATION TREASURE HUNT IS A CONTEST OF SKILL
Vacation Treasure Hunt is a skill contest designed to provide entertainment to online visitors of the ResortQuest.com Web site during the Promotion Period. Participants will be required find the location of a specified Treasure Map image that has been placed on one Web page within the ResortQuest.com Web site. Each week, Participants will be given clues that will hint at the location of the Treasure Map image. The clues will be released one at a time over a period of time until that week's Contest has been won or discontinued. When the image is found and clicked, the following Web page will reveal a toll-free phone number and secret code. The winner of the Vacation Treasure Hunt will be the first participant meeting the Offical Rules criteria who calls the specified phone number, provides the correct secret code and completes the booking transaction.

2. PRIZE WINNER SELECTION
Sponsor will award a total of one Prize per week for the duration of the Promotion Period. The winner will be determined by judges appointed by the Sponsor based on the following criteria:
To be eligible for the Prize, you must satisfy the Official Rules and agree to the Terms and Conditions;
You must sign all waivers and agreements as required by the Sponsor;
You must participate in the Vacation Treasure Hunt online at ResortQuest.com;
All winners require legal proof of age, identity and residency along with a submitted photo if requested;
You must be the first participant to call the specified toll-free number, provide the correct secret code to the reservations specialist and complete the booking transaction before 11:59pm (CST) on the Monday before the next week's Contest begins;
You must accept the vacation rental unit as predetermined by Sponsor;
You must accept the rental period as predetermined by Sponsor.

One Prize will be awarded per week during the Promotion Period to the first participant meeting the Official Rules criteria who calls the specified phone number, provides the correct secret code and completes the booking transaction. Winner will be determined on or before 11:59pm (CST) of the Monday before the next week's Contest begins. All decisions of the judges shall be final. All unclaimed or unawarded prizes are forfeited. Winners and Contest participants grant Sponsor the right to use their name and likeness (including voice) for promotional purposes with no additional compensation.

3. PRIZE
Prizes: One Prize winner per week will win the option to purchase a five-night stay for a special rate of one (1) U.S. Dollar per night during a designated time period at a ResortQuest-managed vacation rental property that has been predetermined by Sponsor (the "Prize"). Prize is not redeemable for cash and may not be extended, transferred or substituted, except that Sponsor may substitute a prize of equal or greater value when necessary, as determined in its sole discretion. Applicable federal, state, and local taxes are the sole responsibility of Winner. Sponsor may require winner(s) to sign an affidavit of eligibility and liability/publicity release. All Prizes awarded may be subject to legal restrictions. In the event that the award of the Prize to the winner of Vacation Treasure Hunt is challenged by any legal authority, Sponsor has the sole right to determine whether or not to award such Prize. In such an event, the Released Parties (defined below) shall have no liability to any participants. No substitution of prizes is permitted, except by Sponsor, in which case a prize of equal or greater value will be awarded. Cannot be redeemed for cash or used as payment toward any ResortQuest account. ALL EXPENSES NOT SPECIFIED HEREIN, INCLUDING, WITHOUT LIMITATION, ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE, ARE EACH WINNER'S SOLE RESPONSIBILITY. Sponsor will report the award of each prize to the Internal Revenue Service and other applicable taxing authorities.
NOTIFICATION AND ACCEPTANCE: Winners will be notified by a reservations specialist immediately upon being the first participant meeting the Official Rules criteria who calls the specified phone number, provides the correct secret code and completes the booking transaction. Confirmation of the award will be given by email and/or regular mail within seven (7) days after the date the winner is determined. Winners must sign and return an affidavit of eligibility and acceptance of these Official Rules and a publicity/liability release (unless prohibited by law) within five (5) days after receipt of notification. Failure to comply with these requirements may result in disqualification and the selection of a new winner, or forfeiture of the Prize, at Sponsor's discretion. Any Prize notification returned as undeliverable may result in disqualification and selection of an alternate winner or forfeiture.

4. ELIGIBILITY
This Contest is open to legal U.S. residents of jurisdictions where this Contest is permissible by law. Entrants must be twenty-one (21) years of age or older, and standard ResortQuest age and occupancy restrictions apply and may vary by vacation rental property. All federal, state and local laws and regulations apply. One winner per household for the duration of the Promotion Period. If an individual finds more than one of the hidden treasure maps, or if another member of his or her household should find another hidden treasure map, he or she will be automatically disqualified from the Contest with no further consideration. Directors, officers, employees, representatives, agents and consultants of Sponsor, and its affiliated companies and parent companies, and all of their partners, affiliates, distributors, divisions, subsidiaries, vendors, suppliers, contractors, and directors, officers, consultants, representatives, agents, employees, and any of their immediate families, are not eligible to win any Prize. The Sponsor reserves the right to require proof of eligibility.

Entries that are incomplete, illegible, unintelligible, fraudulent or corrupted are void and disqualified.

5. PRIVACY
By participating, each participant agrees to this Web site's Terms of Use and Privacy Policy and the rules stated herein.

6. RULES OF CONDUCT
If, for any reason, any portion of Vacation Treasure Hunt is not capable of being conducted as planned, then Sponsor reserves the right to modify, suspend or cancel the Contest or any portion thereof. Sponsor reserves the right, at its sole discretion, to disqualify any participant who violates these Official Rules or the associated Terms and Conditions incorporated herein, or who tampers with the enrollment process, or who engages in any conduct detrimental to the Sponsor, the Contest or any other participant (in each case, as determined by Sponsor in its sole discretion), to suspend or terminate any participant whose eligibility is in question, and to cancel, terminate, modify, or suspend this Contest at any time.

7. USE OF ENTRANTS' NAMES AND PHOTOGRAPHS
By entering the Contest, each entrant grants permission, without further compensation, to allow Sponsor to use the entrant's name, photograph and other material for broadcast in its publications and on its Web site. Guests of contestants using the Prize also grant permission without further compensation to allow Sponsor to use their name, photograph and other material for broadcast in its publications and on its Web site. By entering, the Contest winner agrees that he or she may be required to sign a release and waiver of liability and a receipt and by failing to do so, the Prize may be forfeited.

8. LIMITATIONS OF LIABILITY
By participating in ResortQuest's Vacation Treasure Hunt, you release and agree to hold harmless Sponsor and its affiliated companies and parent companies, and all of their partners, affiliates, directors, officers, employees, consultants, and agencies ("Released Parties") from any and all liability, claims or actions of any kind whatsoever for any claims, costs, injuries, damages or losses of any kind to persons and property which may arise from or be sustained in connection with participation in the Vacation Treasure Hunt, receipt, claim to or use of any Prize or while traveling to and from a location to claim or use any Prize (including without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, whether under a theory of contract, tort (including negligence), warranty or other theory.
The Released Parties make no warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use or value of any Prize including, without limitation, quality, merchantability, or fitness for a particular purpose. The Released Parties are not responsible for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network or utility connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by Sponsor, any participant, or by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest and which may limit a participant's ability to participate in this Contest. Sponsor is not responsible for errors, problems or delays in Internet service or telephone systems that may prevent callers or entries from reaching us. If a caller gets disconnected for any reason before the booking transaction is complete, another Contest participant's call will be taken.

9. OFFICIAL RULES/WINNERS' LIST
Participating in Vacation Treasure Hunt is subject to these Official Rules and the Terms and Conditions, the ResortQuest Privacy Policy and any other rules expressly referenced herein. For an additional copy of the Official Rules, send a self-addressed, stamped envelope to: Vacation Treasure Hunt c/o Marketing Department ResortQuest, 546 Mary Esther Cut-Off NW, Ste. 3, Fort Walton Beach, Florida 32548, Attn: Official Rules. Requests for Official Rules must be received by April 20, 2010. Residents of VT may omit return postage on rules requests. A winners' list may be obtained after April 20, 2010 by sending a self-addressed stamped envelope to the address above, Attn: Winners' List.

10. SPONSOR
The Sponsor of this Contest is ResortQuest International, LLC, 546 Mary Esther Cut-Off NW, Ste. 3, Fort Walton Beach, Florida 32548.

11. MISCELLANEOUS
In the event that any provision of these Official Rules (or Terms and Conditions) is found invalid or unenforceable pursuant to judicial decree or decision the remainder of the Official Rules and Terms and Conditions shall remain valid and enforceable according to their terms. The parties intend that the provisions of these Official Rules be enforced to the fullest extent permitted by applicable law, and if any provisions are deemed unenforceable, they shall be deemed modified to the extent necessary to make them enforceable. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion. Sponsor reserves the right to halt, modify or suspend the Contest at any time for any reason. In the event that the Contest is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Contest or to disqualify residents in the affected geographic area. In such event, Sponsor shall have no liability to any participants who are disqualified due to such an action. This Contest may not be used for any form of gambling. Inquiries concerning entries will not be accepted. Travel Insurance is not available for any Vacation Treasure Hunt prize. ResortQuest Exclusive Snow Guarantee does not apply to any Vacation Treasure Hunt prize.

12. CONTEST ADMINISTRATION
The Contest shall be governed by, construed and enforced in accordance with Central Standard Time (CST) and the laws of the State of Florida, without regard to conflict of law principles in the Florida courts. Participation is acknowledgment of an agreement to be bound by all terms and conditions of these Official Rules. By participating, participants agree that Sponsor, in its sole discretion, will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by Sponsor regarding the Contest shall be final and binding in all respects.

THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.
